Sec377 Abolished; Love Wins!

In a historic judgment, the Supreme Court today has abolished the vexed Section 377. For those of you who are not familiar with it, Section 377 is a 158 year old British law against homosexuality. The Supreme Court reversed its own decision which they had made in 2013 restoring Section 377.

The United Nations lauded the Supreme Court for scrapping the controversial law. They said that the judgment will help boost efforts to eliminate discrimination against the LGBT community. Sexual orientation is natural and people can’t help it. Moreover, people should have no right to comment on or declare anyone else’s choices to be illegal or unnatural.

The judgment was delivered by a Bench of Chief Justice of India Dipak Misra and Justices Rohinton Nariman, AM Khanwilkar, DY Chandrachud and Indu Malhotra. “LGBT Community has same rights as of any ordinary citizen. Respect for individual choice is the essence of liberty; LGBT community possesses equal rights under the constitution. Criminalising gay sex is irrational and indefensible,” said Chief Justice Dipak Misra, who headed the five judge bench hearing the case.

 

This judgment was celebrated by millions of people from the LGBT community who had been fighting long and hard. The celebration was not only limited to the community. Straight people across the country were extremely happy and supportive of the decision. The LGBT community who has been living under fear of prosecution can now live without fear and stigma.

The Supreme Court was firm that no minority group, however small it may be compared to the majority should be deprived of equal rights. Even though the petition was opposed by Christian bodies like the Apostolic Alliance of Churches and Utkal Christian Association, it was necessary to understand and respect the choices that an individual makes. Moreover, the SC also stated that no longer will homosexuality be considered as a disability.

After the decision, social media was flooded with celebrities and politicians supporting the verdict.
